Terms of Service

Effective Date: November 27, 2025

By accessing and using the services provided by OmneHosting (hereinafter, “OmneHosting,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (ToS) and our Acceptable Use Policy (AUP).

1. Service Provision and Account Management

1.1 Service Guarantee

OmneHosting commits to providing premium game server hosting services with a 99.9% Uptime Guarantee. Hardware issues and planned maintenance are excluded from this calculation.

1.2 Data and Backups

You are solely responsible for the content, data, and files maintained on your game server. OmneHosting does not guarantee the integrity of any data stored on our systems. While we may perform routine backups for disaster recovery, you must maintain your own independent, external backups of all server files and configuration data.

1.3 Termination of Service

We reserve the right to suspend or terminate your service immediately, without prior notice, if you breach any section of these ToS, including the Acceptable Use Policy (Section 3), or fail to make timely payments.

2. Billing and Payment (Via Paymenter)

2.1 Billing Cycle

All services are billed on a recurring [Monthly/Quarterly/Annually] basis. You agree to submit payment for services in advance of the service period.

2.2 Payment Information

All billing and payment processing are handled through the Paymenter platform and its integrated third-party payment gateways. You agree to keep your billing information accurate and current.

2.3 Non-Payment

Failure to pay invoices within 48 hours of the due date may result in the automatic suspension and, subsequently, termination and deletion of your game server data.

3. Refund Policy (Money-Back Guarantee)

3.1 Eligibility Window

OmneHosting offers a 72-hour Money-Back Guarantee on the first purchase of any new game server plan. If you are dissatisfied with the service, you may request a full refund of the base service fee (excluding any setup fees, license costs, or domain registrations) within 72 hours of the initial service activation.

3.2 Refund Exclusions (Voided Guarantee)

The 72-hour Money-Back Guarantee is void under the following conditions:

  • Violation of the Acceptable Use Policy (AUP): Any refund request resulting from a server suspension due to an AUP violation is automatically ineligible for refund.

  • Renewals or Upgrades: The guarantee applies only to the first purchase of a service, not to renewals, upgrades, or subsequent service purchases.

  • Service Abuse: Abuse of the refund system (e.g., repeatedly signing up and requesting refunds) will result in account termination without refund.

3.3 Processing

Refunds, if approved, will be processed back to the original payment method within 1–14 business days.

4. Acceptable Use Policy (AUP)

You agree to use OmneHosting’s services strictly for their intended purpose—running legitimate game servers—and agree not to use our services for any prohibited activities.

Prohibited Activities Include, But Are Not Limited To:

  • Illegal Content: Storing or transmitting any material that violates applicable local, state, national, or international law.

  • Network Abuse: Engaging in activities that disrupt or negatively impact the service of other customers or the integrity of our network, including:

    • Initiating or participating in Denial-of-Service (DDoS) attacks against other networks or servers.
    • Running botnets or other malicious software.

  • Cryptocurrency Mining: Using server resources (CPU/GPU) for cryptocurrency mining operations.

  • Mass Mailings/Spam: Using the server’s network connection to send unsolicited bulk email (spam).

  • Pornography: Hosting or linking to any illegal pornography or content.

  • Intellectual Property Infringement: Hosting any pirated software, cracked license keys, or copyrighted material without legal authorization.

4.1 Consequences of Violation

Violation of the AUP is grounds for immediate service suspension or termination. We reserve the right to remove any illegal, obscene, or infringing materials from our servers at any time.

5. Limitation of Liability

OmneHosting shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the services, including, but not limited to, loss of data, income, or profits, regardless of whether we were advised of the possibility of such damages.
